(a) A referendum shall be held on the date of the General Election in the Year 2000 to enable the voters of the Virgin Islands to decide whether the Legislature should petition the United States Congress to amend the Revised Organic Act to reduce the number of Senators comprising the Virgin Islands Legislature. (b) The Board of Elections shall place the following questions on the ballot: ‘Mark One Square Only For Both Questions l(a). Should the Legislature petition the United States Congress to amend the Revised Organic Act to reduce the size of the Legislature? [ ] [ ] YES NO 1(b). If your answer to question 1(a) is "YES", please indicate whether you favor a reduction of senators from 15 to [J or [ ] 11 9." (c) The Board of Elections shall certify and provide to the Legislature within 10 days after the General Election, the actual number of votes cast on the referendum as a Ls esd = set forth in subsection (b) of this Section and the number of votes cast for each choice, whether or not fifty percent plus one of the persons casting a ballot voted on the issue. Act 6297 (Bill 23-0174), section (g), is amended by adding after the words “ December 31, 1999 ” the following: “or as soon thereafter as is possible. Nothing in this language shall be construed to mean that the Internal Revenue Bureau must forgo its usual operational procedures.” SECTION ___ Act No. 6333 (Bill No. 23-0178), section 29, subsection (a), is amended in the first sentence by deleting “January 1,” where it appears and inserting in lieu thereof “April 1”, and in the second sentence, by deleting the phrase, “within 15 days of collection” and inserting in lieu thereof, “on a monthly basis in accordance with the established billing and collection practices of the Virgin Islands Telephone Corporation and other local service providers.” EXPLANATION The Internal Revenue Bureau must check all income tax refunds filed each year for errors in calculations, disallowed claims for exemptions, etc. Given the short time between the collections from the 1999 Bonds and the December 31, 1999 deadline for tax refunds, it was physically impossible to have all refunds due issued by that date. Some returns are still being audited by the Bureau and the persons involved are required to present additional documentation before any refunds can be issued. In some cases, a person may be expecting a refund, only to find that due to some error in calculations or disallowed exemptions claimed, he or she may actually owe money to the Internal Revenue Bureau instead. All these factors and more have resulted in delays in the need to extend the December 31, 1999 deadline. The second section of this amendment amends section 29(a) of Act No. 6333, pertaining to the $1 emergency surcharge to be added to telephone bills. The amendment is needed to afford telephone companies sufficient time to implement their mandate to oe collect the surcharge. In addition, the amendment is calculated to facilitate compliance by changing the schedule for remittance of surcharge payments to the Government, so as be compatible with the companies’ established collection and billing practices. AMENDMENT EXPLANATION Section 8 of Act 5224 limits the Governor's appointment powers to the Industrial Development Commission until the Commission reaches 2 - 4 members: the Commissioner of Tourism, the Director of the Virgin islands Bureau of Internal Revenue, and 2 or fewer appointive members. Only then can the Governor appoint new members. Section 8 also reduces the quorum from 4 members to % of the members holding office at the time, plus one. This could result in a quorum of only 2 members. This Amendment repeals §8 of Act No. 5224, thus returning to the prior law requiring seven members, including 5 appointive members, and a quorum of 4, with not more than 3 members from the same district. Also, the Amendment allows an appointive member, when his term expires, to serve until his successor is appointed and confirmed. During 1997 the Joint Boards of Elections wrote the members of the Twenty-Second Legislature documenting our intent and efforts to submit a comprehensive proposal for reforming Title 18 of the Virgin Islands Code. In May of 1997 we again wrote the Legislature requesting their patience and consideration for allowing the Joint Boards of Election to conduct public hearings on our proposals. During May of 1997 we conducted public hearings on the islands of St. John, St. Thomas and St. Croix respectively. During these hearings we receive the support and endorsements of all political parties, the League of Women Voters and other organizations and individuals for our proposal of having all Political Parties in the Virgin Islands conduct their own party primaries to elect party and public representatives for their respective parties. The members of the Joint Boards submitted to then Senate President Berry and all members of the Twenty-Second Legislature our Election Reform Proposals, along with copies of the transcripts for all hearings held by the Joint Boards. For approximately one year the Joint Boards awaited the consideration of our proposals by the Legislative body. On June 26, 1998 the Legislature passed some of the items in our proposals, in a bill to approve the health insurance agreement between the Government of the Virgin Islands and Aetna Life Insurance Company (Act. No. 6239) Subsequently on July 16, 1998 the Legislature passed the other portions of our Election Reform proposal and also corrected some of the inaccurate measures passed in Act No. 6239. (Act No. 6246) Following these actions of the Legislature the Elections System began the implementation of the applicable changes and lauded the members of the Twenty- Second Legislature for these long awaited changes. Since these changes were made the members of the Elections System began preparing and educating the general public of the upcoming changes in the 2000 elections. Elections Reform Fact Sheet Page 2. 11. In January of 2000 we began the process of adopting rules and regulations for political parties to conduct their respective party primaries. 12. During this process we discovered that the changes recommended in Section 232 of Title 18 in the Virgin Islands Code was not appropriately adopted in Act No. 6239. 13. Specifically, the language “and candidates for public office”, was not included in the amendments to the law. : 14. This inadvertent act is presently in contrast with other sections of the Elections laws and poses a threat for confusing the Elections System and political parties in the implementation of primaries by political parties. We are therefore requesting that corrective action be taken to rectify this problem. It is still our position, and that of political parties and organizations, that it is more economically feasible for these activities to be conducted by these organizations. (a) Notwithstanding any other law, the Board of Trustees of the Government Employees’ Retirement System, as established under Title 3, Chapter 27, Virgin Islands Code, shall purchase Parcels No. 5 and 6, Remainder of Parcel No. 3, Estate Orange Grove, Company Quarter, St. Croix, Virgin Islands consisting of approximately 2.971 U.S. acres, which presently houses the Casino Control Commission and the Government Employees’ Retirement System’s St. Croix offices. In purchasing the property, the Board shall, if it has not done so already, adopt substantially similar procedures for the acquisition of property by the Government of the Virgin as provided under Title 31, Section 231a, Virgin Islands Code. (b) Title 3, Chapter 27, Virgin Islands Code, is amended by adding a new Section 735 to read as follows: “Section 735. Tax exemptions of the System; protection from judicial process (a) All property, including funds of the System, shall be exempt from levy and sale by virtue of execution, and no execution or other judicial process shall issue against the same nor shall any judgment against the System be charge or lien upon its property. As per your earlier telephone conversation with Attomey Nibbs, { am pleased with your willing eagerness to sponsor the foregoing legislation on behalf of the System. The System has recently obtained an Option to purchase Parcels No. 5 and 6 Estate Orange Grove, Comipany Quarter, St. Croix. To conclude the purchase of this real estate transaction, statutory authorization is required. Time is of the essence in this matter. After forty (40) ycars, the System is pleased to have found such a suitable site to make a permanent home for our St. Croix Office. The Board of Trustees has a strong interest in making this local investment on the Island of St. Croix. This investment is signiticant for a number of reasons. Firstly, it will provide a permanent hame for the GERS, and has great potential to bc a substantial revenue producer for the System, Secondly, it will add equity in terms of our real estate holdings; and finally. it will enable the System to realize savings on the amount of recurrent rental expenses. The title to the land shall be exclusively subject to approval by the Optionee, and all the costs and expenses of curing any defect or defects in the title shall be bome by the Optionor; and such costs and expenses, together with all moneys required for the satisfaction of taxes, liens or encumbrances may be reserved from the purchase price and applied directly to the curing of such defects, if any, and (o the satisfaction and release of such taxes, liens, and encumbrances. All taxes for the year 1999 shal! be paid by the Optionor up to the date title is vested in the Optionee. 6. Imperfect Title. If title is merchantable, Optionee shall pay for Certificate of Title. If title is found imperfect and seller cannot perfect and Optionor cannot perfect title within ninety (90) days after date fixed for closing, any carest moncy deposited shall be returned to the Optionee; and Optionor shall pay to Optionee other costs including title processing charges. 7. Destruction of Premises. If, after Sale Contract is executed, the premises be | destroyed or damaged for fire, windstorm, acts of God, or otherwise, Optionor shall restore same within sixty (60) days, if possible, and the sale closing date shall be extended accordingly, but otherwise Optionce shail have option of canceling or enforcing Contract; if enforced, Optionce shall be entitled to insurance; if canceled, carnest deposit shall be returned to Optionee. Optionce agrees to hold Optionor harmless against any claims for brokerage commissions arising out of any conversation ~ er or negotiations had by Optionee with any broker. 10. — Failure to Exercise Option. Act No. 5999 (July 22, 1994), §12, | (2), is amended to read as follows: “ (2) In Section 3, in the first undesignated sentence, strike the words ‘ten years’ and insert in lieu thereof 'thirty years’. AMENDMENT EXPLANATION This amendment clarifies a technical error in Act. No. 5999, § 12. Act 5999, §12, 4/2 amended Act No. 5168 (June 11, 1986), §3 concerning the franchise granted to Transportation Services of St. John and Varlack Ventures, Inc. Act No. 5168, §3 granted a ten year franchise. In addition, pursuant to Act No, 5168, §3, subsection (b), the franchise did not prohibit the transport for a fee of not more than ten passengers by other companies. Act No. 5999, § 12, 42, simply struck "ten", and inserted "thirty" which increased the franchise to thirty years and the passenger limitation from ten to thirty. This amendment makes it clear that the Legislature intended to increase ONLY the franchise to thirty years, NOT the passenger limitation.
