® An Or 'inance CREATING A COMMISSION TO R4G- ULATE AND CONTROL THE PHIC- ES OF FOODSTUFFS IN THEE MUN!- CIPALITY OF ST. CROIX, AND FFOR OTHER PURPOSES. Be it enacted by the Colonial Council for St. Croix in Session assembled: 1. The Governor of the Virgin Islands is hereby authorized and empowered to appoint a Commission to fix and regulate the selling prices for \rti- cles of food sold in St. (roix, and 'o carry out the powers and duties hereinafter set forth. 2. The said “ommission shall be known as the ‘“‘Food Commission of St Croix’’. The members of whnich shall be residents of St. Croix. The Governor shall name the Chairman of the Commission. The members of the Food Commission shall be ap- pointed for a period of one year and shall continue in office thereafter until their successors are apbointed and qualified. : 3. The Food Commission shall have power to investigate the prices at whieh all articles of food are sold or purchused by importers, merchats, dealers, producers, manufacturers, or consumers, and for that nurpose the books of all sueh shall be open to inspection by the Food Commission, and, if necessary, it may issue sub- poenas lor the attendance of wit- nesses or for the production of books or other documents, and it shall have the power to take testimony under oath. 4. It shall have the power to determine the prices and quantities at which all or any article of food may be sold by wholesalers, retailers, prodic- ers or manufacturers, vrovided however, a reasonable margin of profit shall be allowed. It shall also have the power to restrict the exportation of ali locally produced or manufacturec articles of ;food. To the extent of the amount required for lot,l consumption; provided the prices fixed for local sale of 2 locelly produced or manufactured article of food shall not be less than the nec cash amount which might pe gained by exportation. 5. It shall have the power to test all weights, scales and measures and to fix standards thereof. 6. It shall have the power to make all rules and regulations necess.ry to efficiently carry out the yowers here- in granted. 7. Any person who shall refuse to appear before the Food Commissior, when summoned, or who shall refuse to tes £ 1 &sl ok &N | » tify, or shall testify falsely, or shal tail t- produce books or documents re- quired or shall seil any article of food in a larger quartity or at a higher price than preseribed by the Food “ommission, or shall use a weight, measure or scale vrohibited by the Food Commission, or shall violate any rule or regulation promulgated by the Food Commission, shall be vuiity of 4 misdemeanour and on con- viction thereof shall be punished by fine of nnt to exceed Francs 1,000:00 or by imprisonment rot to exceed six months or by both such fine and im- prisonment bv the diseretion of the Court. 8. All prosecutions or violations >t this Ordinance shal! be by informaton filed by the Government Attorney in the Ordinary Towvn Court.
