ACTNO. 8261 BILL NO. 33-0 130 THIRTY-THIRD LEGISLATURE OF THE VIRGIN ISLANDS Regular Session 2019 An Act amending title 23, chapter 19, subchapter I, section 1519 of the Virgin Islands Code by adding a new subsection (c) to protect members of the Virgin Islands National Guard from civil action court proceedings while they are on Territorial active military service ---0--- Be it enacted by (lie Legislature of (lie Virgin Islands: SECTION 1. Title 23, chapter 19, subchapter 1. section 1519 of the Virgin Islands Code is amended by adding a new subsection (c) to read as follows: “(c)( I )Notwithstanding any other law to the contrary, a civil court action against a Virgin Islands National Guard member called by the Governor into Territorial military service shall be stayed for a period of thirty (30) consecutive days by the court on a motion filed on behalf of the National Guard member, unless the court finds that member’s ability to prosecute or defend is not materially affected by the member’s active military duty. …
