THOMAS, U.S. VIRGIN ISLANDS I. PROJECT DESCRIPTION A. Project Number - Project CT VI-0A30(035), Contract 3, was located on Long Bay Road (Route 30), St. Thomas, U.S. Virgin Islands. B. Description of Work – Widen and reconstruct Long Bay Road (Route 30) with asphalt pavement, relocation of utilities, drainage, signal system, concrete curb and gutter sidewalk, street lights and other miscellaneous works. C. Permits – Building Permit - United States Virgin Island Department of Planning and Natural Resources (VIDPNR) issued an extension of Permit No. STT 512-04 with effective date of July 1, 2004, and an expiration date of November 30, 2007. The new expiration date is October 23, 2007. CZM Permit -United States Virgin Island Department of Planning and Natural Resources (VIDPNR) issued a modification of CZM Land Permit No. CZT-12- 03(L) with an application date of June 10, 2003. II. PROJECT DATA A. Specifications – Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects, FP-03 (US Customary units) B. Termini – Long Bay Road (Route 30) Construction began at Station 17+00 at intersection with Veteran’s Drive, DeBeltjen Road and Lover’s Lane and continued east to Station 31+50 C. Length – Long Bay Road 0.28 miles Total length 0.28 miles 1 D. Width – Long Bay Road: Consisted of: Two 11-foot lanes on each direction from Station 17+00 to Station 31+50: a total width of 55 feet There are medians located between Station 20+00 and Station 21+85 with a width of 11 feet Station 23+12 to Station 23+87.15: width of 11 feet Station 26+38 to Station 29+40: variable width between 5 and 11 feet Station 30+00 to Station 30+50: width of 5 feet, with turning lanes in all of the other areas. E. Pavement Structure – Long Bay Road received new pavement structures from Station 17+00 to Station 31+50. The pavement structures consisted of roll proofed sub-grade with 8 inches of aggregate base grading C, 6-inch base course of Marshal Hot Asphalt Concrete pavement, Class B, Grading A, and as a surface course, 2 inches of Marshall Hot asphalt concrete pavement class B Grading D. Experimental or New Features – None C. Changes and Problems – 1. Changes Contract Modification (CM) No. 0001 This contract modification was issued as a unilateral contract modification to incorporate the subsection 107.11 and 109.08 reporting requirements under the American Recovery and Reinvestment Act (ARRA) into the contract. No Change in the contract amount No change in contract time. CM No. 0002 was issued to address three issues that arose during the performance of the contract work. The first issue concerned the existing overhead utilities and electrical cables along the north side of Long Bay Road (LBR). These overhead utilities were in direct conflict with the installation of proposed street lighting along the north side and with the traffic signal system at the entrance to Yacht Heaven Grande. In addition, overhead cables were also in direct conflict with the proposed palm trees along north side as part of landscape and irrigation work on Contract 4. The conflicting overhead cables could not be removed unless underground utility grid was installed first. However, contract plans for the LBR project did not have provision for the installation of underground electrical and communication grids (power, phone, cable, internet, etc.). On previous projects, (Veteran’s Drive and Centerline Road & Extension), the underground utility grid work was included as part of the contract in order to remove existing overhead cables and poles in the area. For Contract 3, underground utility grid work was not included in the project work. To resolve this problem, several meetings were held between EFLHD, Virgin Islands’ Department of Public Works (VIDPW), and local utility companies. As a result, it was clear that local utility companies were unable to execute this work. In order to remove existing overhead utility cables and install proposed street lights and signals, VIDPW verbally requested EFLHD to include the underground utility work as part of Contract 3. This verbal request was followed by a letter dated May 4, 2010, from the Commissioner of VIDPW requesting EFLHD to execute a contract modification in order to install underground utility conduits as part of VI 0A30 (35) Contract 3. This CM created several new pay items for the installation of underground electrical and communication conduits with concrete encasement, manholes, and connection units including concrete encasement, rigid conduits at the risers according to the USVI code. 9 The second issue concerned adjustment, increase, of the quantity of three existing items (reinforcing steel, curb& gutter, and sidewalk). The final issue concerned contract time. This contract action increased the total dollar amount for the project and changed the completion date from September 11, 2010, to January 9, 2011. Net contract increase = $985,016.40 Contract time increase = 120 calendar days. CM No. 0003 was issued as a bilateral contract modification to address several issues that arose during the performance of the contract. The first issue concerned redesign of traffic signals and street lighting system. Original contract called for 110 mph design winds for traffic signals and street lights but USVI required 145 mph winds to withstand hurricane winds, as per AASHTO. This CM equitably compensated the contractor to submit wind design changes for the traffic signals and street lights. The second issue concerned construction of a new reinforced block wall in front of the Yacht Haven Grande (YHG) property. DPW requested that a new wall similar to the wall on the left side be built in front of the YHG property. The third issue concerned FHWA field office. The original contract time was 300 days but due to time extensions granted by the Government (due to issues beyond the control of the contractor), contractor incurred additional expenses beyond the 300-day bid price. This CM equitably compensated the contractor for the additional costs associated with the FHWA field office. The fourth issue concerned reduction of the quantity of an existing item (removal of pavement, concrete). The fifth issue concerned contract time. Contractor requested 220-day extension and this CM changed the completion date from January 9, 2011, to August 16, 2011. The underrun for pavement removal item compensated for the new items and overall there was a net reduction in the contract amount. Net contract decrease = $21,116.28 Contract time increase = 220 days. CM No. 0004 (Final): This contract modification was issued to adjust the quantities of existing items. The contractor did not request an equitable adjustment of the unit price of those items with significant (+ 15%) changes. Item 63610-3200 CM#002, 09/07/10 Contract Modification Work (Conduit 3- inch Rigid) Underran by 100 percent as Item was not used on the project, Included by mistake of Utility Companies Innovative and WAPA. 2. Problems One of the problem was the existing overhead utilities and electrical cables along the north side of Long Bay Road (LBR). These overhead utilities were in direct conflict with the installation of proposed street lighting along the north side and with the traffic signal system at the entrance to Yacht Heaven Grande. In addition, overhead cables were also in direct conflict with the proposed palm trees along north side as part of landscape and irrigation work on Contract 4. These conflicting overhead cables could not be removed unless underground utility grid was installed first. However, contract did not have provision for the installation of underground electrical and communication grids (power, phone, cable, internet, etc.). To resolve this problem, EFLHD received a written request from the Commissioner of VIDPW to execute a contract modification to install needed underground utility conduits. DPW requested reconfiguration of through and turning lanes to ease traffic at the Lovers Lane, Long Bay Road, and Veterans Drive intersection. Turn lane lengths were increased to provide more storage area for the turning traffic and ease congestion for the through traffic. This reconfiguration helped ease traffic flow through the intersection, which has many movements in several different directions. The problem of traffic management through the intersection was satisfactorily resolved through close field coordination between DPW, Contractor, and EFLHD project engineer. D.
