COMMITTEE ON HOMELAND SECURITY, JUSTICE AND PUBLIC SAFETY 06/05/2025-REPORTED OUT TO THE COMMITTEE ON RULES AND JUDICIARY BILL NO. 36-0057 Thirty-Sixth Legislature of the Virgin Islands March 28, 2025 An Act amending title 5 Virgin Islands Code, chapter 314, section 3733, subsection (a) to require automatic expungement of the arrest record and complaint or information when the accused has been acquitted PROPOSED BY: Senator Alma Francis Heyliger Be it enacted by the Legislature of the Virgin Islands: 1 SECTION 1. Title 5 Virgin Islands Code, chapter 314, section 3733, subsection (a) is 2 amended by striking paragraph (2) and by adding the following subsection (c): 3 “(c) Upon the acquittal of an accused, the Court shall enter an order expunging the 4 accused record of the arrest and the criminal complaint or information upon which the accused 5 was tried.” 6 BILL SUMMARY 7 This bill requires the Court enter an order expunging the arrest record and the complaint 8 or information upon which the accused was tried, if the accused was acquitted of the charges. …
