(Board of Trustees Meeting, February 21, 1982) 171 The undersigned does hereby certify that the following is an exact 7 cony of a Resolution of the Board of Trustees adopted at its meeting on February 21, 1982, as recorded in the Minutes of the said meeting. RESOLUTION OF THE BOARD OF TRUSTEES OF THE COLLEGE OF THE VIRGIN ISLANDS WHEREAS, the Virgin Islands Port Authority is desirous of locating an airport control tower on the property of the College; and WHEREAS, the Virgin Islands Port Authority is desirous of relocating on College property its right-of-way to a parcel belonging to the Port Authority, namely Parcel No. 71 Lindberg Bay; and WHEREAS, in exchange for ninety-nine year use permits to accomplish the foregoing, the Virgin Islands Port Authority is willing to give to the College of the Virgin Islands a ninety-nine year use permit to occupy, use and possess property of the Port Authority containing a one-million gallon storage tank, a 67,000 gallon gravity tank, pumphouse, and related pipes, together with a right-of-way on the section of road leading to the rear of the College library; and & WHEREAS, the College has been utilizing the storage tank, gravity tank, phmphouse, and related pipes, together with the right-of-way to the rear of the library without formal authorization from the Port Authority to do.so, and is desirous of obtaining formal consent to the use of the property; NOW THEREFORE, be it resolved that the President and Vice President of Business and Financial Affairs of the College of the Virgin Islands are hereby authorized to execute any and all documents, including but not limited to use permits, necessary to grant to the Virgin Islands Port Authority for ninety-nine _ years, an area in which to locat®-an airport control tower, and ~an area in which to relocate a right-of-way to Parcel No. 71 ‘Lindberg Bay, in exchange for the grant to the College of .the. Virgin Islands by the Port Authority of permission to use and occupy, itor ninety-nine years, a one-million gallon storage tank, a 67,000 gallon.gravity’ tank, pumphouse, and related pipes, to- “gether with a right-of-way, to the rear of the library of the College; and to obtain any and all necessary Federal approval to accomplish the foregoing, on such terms and conditions as the President and Vice President, in their discretion, deem necessary ‘ or appropriate.
