DELEGATE TO SENATE FROM EACH TERRITORY. 1 Each Territory shall be represented in the United 2 States Congress by a Delegate to the United States Sen- 3 ate. The Delegate shall be a nonvoting Delegate in the 4 Senate, elected as provided in this Act. 5 SEC. 3. ELECTION OF DELEGATE. 6 (a) ELECTORS AND TIME OF ELECTION.—The Dele- 7 gate for a Territory shall be elected— 8 (1) by the people qualified to vote for the popu- 9 larly elected officials of the Territory; 10 (2) at the first Federal general election occur- 11 ring at least one year after the date of the enact- 12 ment of this Act and at each Federal general elec- 13 tion every 6 years thereafter; and 14 (3) at a special election, if required due to a 15 mid-term permanent vacancy. 16 (b) MANNER OF ELECTION.— 17 (1) IN GENERAL.—The Delegate shall be elect- 18 ed at large and by a plurality of the votes cast for 19 the office of Delegate. 20 (2) EFFECT OF ESTABLISHMENT OF PRIMARY 21 ELECTIONS.—Notwithstanding paragraph (1), if the 22 Government of the Territory, acting pursuant to leg- 23 islation enacted in accordance with the Constitution 24 of the Territory, provides for primary elections for 25 the election of the Delegate, the Delegate shall be 26 VerDate Sep 11 2014 20:15 Dec 29, 2019 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H5526.IH H5526 pamtmann on DSKBC07HB2PROD with BILLS 3 •HR 5526 IH elected by a majority of the votes cast in any general 1 election for the office of Delegate for which such pri- 2 mary elections were held. 3 (c) VACANCY.—In case of a permanent vacancy in the 4 office of Delegate, the office of Delegate shall remain va- 5 cant until a successor is elected and qualified. 6 (d) COMMENCEMENT OF TERM.—The term of the 7 Delegate shall commence on the 3d day of January fol- 8 lowing the date of the election. 9 SEC. 4. QUALIFICATIONS FOR OFFICE OF DELEGATE. 10 To be eligible for the office of Delegate a candidate 11 shall— 12 (1) be at least 30 years of age on the date of 13 the election; 14 (2) have been a citizen of the United States for 15 at least 9 years prior to the date of the election; 16 (3) be a resident and domiciliary of the Terri- 17 tory prior to the date of the election for a period to 18 be determined by the Government of the Territory; 19 (4) be qualified to vote in the Territory on the 20 date of the election; and 21 (5) not be, on the date of the election, a can- 22 didate for any other office. 23 VerDate Sep 11 2014 20:15 Dec 29, 2019 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H5526.IH H5526 pamtmann on DSKBC07HB2PROD with BILLS 4 •HR 5526 IH SEC. 5. DETERMINATION OF ELECTION PROCEDURE. 1 Acting pursuant to legislation enacted in accordance 2 with the Constitution of the Territory, the Government of 3 the Territory may determine— 4 (1) the order of names on the ballot for election 5 of Delegate; 6 (2) the method by which a special election to fill 7 a permanent vacancy in the office of Delegate shall 8 be conducted; 9 (3) the method by which ties between can- 10 didates for the office of Delegate shall be resolved; 11 and 12 (4) all other matters of local application per- 13 taining to the election and the office of Delegate not 14 otherwise expressly provided for in this Act. 15 SEC. 6. COMPENSATION, PRIVILEGES, AND IMMUNITIES. 16 Until the Rules of the Senate are amended to provide 17 otherwise, the Delegate from the Territory shall receive 18 the same compensation, allowances, and benefits as a 19 Member of the Senate, and shall be entitled to whatever 20 privileges and immunities are, or hereinafter may be, 21 granted to any other member of the Senate, except that 22 a Delegate shall be nonvoting on final Senate votes. 23 SEC. 7.
