Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Virgin Islands Na- 4 tional Park Land Exchange Act of 2005’’. 5 2 •HR 272 IH SEC. 2. LAND EXCHANGE, VIRGIN ISLANDS NATIONAL 1 PARK. 2 (a) CONVEYANCE AUTHORIZED.—The Secretary of 3 the Interior may convey to the Government of the United 4 States Virgin Islands all right, title, and interest of the 5 United States in and to the parcel of real property, includ- 6 ing any improvements thereon, located within the bound- 7 aries of Virgin Islands National Park on the island of 8 Saint John, Virgin Islands, and depicted as ‘‘NPS Lands 9 for Conveyance’’ on the map entitled ‘‘Virgin Islands Na- 10 tional Park Land Exchange’’, numbered 11 lllllllll, and dated llll 2005, for the 12 purpose of providing a suitable location for the establish- 13 ment of a school by the Government of the United States 14 Virgin Islands on the island. 15 (b) CONSIDERATION.—(1) As consideration for the 16 conveyance of the real property under subsection (a), the 17 Government of the United States Virgin Islands shall con- 18 vey to the Secretary the parcel of real property, including 19 any improvements thereon, depicted as ‘‘Lands for NPS 20 Acquisition’’ on the map referred to in subsection (a). 21 (2) If the fair market value of the real property re- 22 ceived under paragraph (1) is less than the fair market 23 value of the real property conveyed under subsection (a), 24 the Secretary may require the Government of the United 25 States Virgin Islands to make up the difference through 26 3 •HR 272 IH the payment of cash, the provision of in-kind consider- 1 ation, or a combination thereof, to be determined pursuant 2 to negotiations between the Secretary and the Government 3 of the United States Virgin Islands. 4 (3) The fair market values of the real property to 5 be exchanged under this section shall be determined by 6 appraisals acceptable to the Secretary and the Govern- 7 ment of the United States Virgin Islands. 8 (c) AVAILABILITY OF MAP.—The map referred to in 9 subsection (a) shall be on file and available for public in- 10 spection in the appropriate offices of the National Park 11 Service. 12 (d) BOUNDARY ADJUSTMENT.—Upon completion of 13 the land exchange under this section, the Secretary shall 14 revise the boundaries of Virgin Islands National Park to 15 reflect the exchange and shall administer the real property 16 acquired under subsection (b) as part of Virgin Islands 17 National Park. 18 (e) ADDITIONAL TERMS AND CONDITIONS.—The 19 Secretary may require such additional terms and condi- 20 tions in connection with the land exchange under this sec- 21 tion as the Secretary considers appropriate to protect the 22 interests of the United States. 23 Æ
