GOVERNMENT OF THE VIRGIN ISLANDS OF THE UNITED STATES Public Services Commission IN RE Order No. 2/2020 ANNUAL ASSESSMENT OF PUBLIC UTILITY FEES Se a ead ORDER OF ANNUAL ASSESSMENT WHEREAS, on Thursday October 3, 2019, the Virgin Islands Public Services Commission (hereinafter “PSC” or “the Commission”) met in Regular Session in its office on St. Thomas located at No. 1003 Estate Ross Suite 4, Barbel Plaza and at the Virgin Islands Port Authority’s Conference Room at the Henry E. Rohlsen Airport located on Croix, United States Virgin Islands; and WHEREAS, based upon the formula mandated in 30 V.I.C. § 25a, all public utilities are subject to the assessment of fees on an annual basis by the Commission; and WHEREAS, the Legislature extended the sole right to Virgin Islands Water and Power Authority (hereinafter “WAPA” or “the Authority”) to pay its annual assessment in equal quarterly installments; and WHEREAS, after careful review and deliberation and the recommendations of its staff, the Commission voied to make the following annual assessment fees on the listed public utilities: Utility 2018 Gross Ratio F/Y 2020 Fees Operating Revenues Virgin Islands Water & Power Authority $ 123,837,341 .00 62.36% | $ 1,119,830.97 Virgin Islands Telephone Corporation d/b/a Viya $ 30,238,150.00 15.23% | $ 273,436.24 Virgin Islands Wasie Management Authority | $ 30,796,383.96 15.51% |$ 278,484.21 Viya Cable TV St. Thomas-St. John $ 4,268,839.21 2.15% | $ 38,602.08 Viya Cabie TV St. Croix $ 3,782,646.44 1.90% {$ 34,205.55 Varlack Ventures, Inc. $ 3,064,284.00 154% |$ 27,709.58 Transportation Services of St. John, Inc. $ _2.598.319.00 1.31% |$ 23,495.97 Total Assessment Revenue: $ 198,585,963.61 100% $1,795,764.59 PSC Order No. 2/2020 — Annual Assessment for F/Y 2020 2|Page NOW THEREFORE, the Commission hereby ORDERS, that the annual assessment on the listed public utilities is set forth and each public utility shall pay the fiscal year 2020 fees by September 30, 2019; and It is hereby ORDERED, that in accordance with 30 V.I.C. § 25a, WAPA shall make its annual assessment payments in four quarterly installments of two hundred seventy-nine thousand nine hundred fifty-seven dollars and seventy-four cents ($279,957.74) each, the first quarterly payment by September 30, 2018, and each succeeding payment at ninety (90) day intervals; and FINALLY, it is hereby ORDERED, that the funds collected from all public utilities will be deposited in the Treasury of the United States Virgin Islands in a special account to be maintained and administered by the Commissioner of Finance designated Special Public Utility Deposit Account as prescribed by law.
