REMOVAL OF THE CAP ON MEDICAID PAY- 1 MENTS FOR PUERTO RICO, THE VIRGIN IS- 2 LANDS, GUAM, THE NORTHERN MARIANA IS- 3 LANDS, AND AMERICAN SAMOA AND ADJUST- 4 MENT OF THE MEDICAID STATUTORY MATCH- 5 ING RATE FOR THOSE TERRITORIES. 6 (a) REMOVAL OF CAP.— 7 (1) IN GENERAL.—Section 1108 of the Social 8 Security Act (42 U.S.C. 1308) is amended by strik- 9 ing subsections (f) and (g). 10 (2) CONFORMING AMENDMENTS.—(A) Section 11 1902(j) of such Act (42 U.S.C. 1396a(j)) is amend- 12 ed by striking ‘‘the limitation in section 1108(f),’’. 13 (B) Section 1905(u) of such Act (42 14 U.S.C. 1396d(u)) is amended by striking para- 15 graph (4). 16 (b) ADJUSTMENT OF FEDERAL MEDICAL ASSIST- 17 ANCE PERCENTAGE (FMAP).—Section 1905(b)(2) of 18 such Act (42 U.S.C. 1396d(b)(2)) is amended by striking 19 ‘‘50 per centum’’ and inserting ‘‘for purposes of this title 20 only 77 percent’’. 21 (c) EFFECTIVE DATE.—The amendments made by 22 this section shall take effect on the date of the enactment 23 of this Act, and shall apply to expenditures made on or 24 after such date. 25 Æ VerDate Nov 24 2008 03:12 Jan 09, 2009 Jkt 079200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6301 E:\BILLS\H92.IH H92 wwoods2 on PRODPC68 with BILLS
