In response to your request, our client retained the services of Pedro Panzardi & Associates to assess the site. On October 31, 1989, we received the preliminary assessment prepared by Panzardi & Associates. This assessment will be sent to your office directly from Panzardi & Associates in- Puerto Rico. Javits Federal Building New York, N.Y. 10278 Re: Tutu Wells Site Dear Mr. Luftig: We are in receipt of your letter dated June 30, 1989, addressed to our client, L'Henri, Inc., wherein you sought to determine whether L'Henri, Inc. would be willing to share in the cost of the investigatorial program to determine the extent of the contamination of the Turpentine Run Basin Aquifer. In response to your request, our client retained the services of Pedro Panzardi & Associates to assess the site. On October 31, 1989, we received the preliminary assessment prepared by Panzardi & Associates. This assessment will be sent to your office directly from Panzardi & Associates in- Puerto Rico. The preliminary assessment indicates that L'Henri, Inc. disposed of only a small quantity of PCE each year. Historically, L'Henri, Inc. has allowed the waste PCE trapped in the filters of its dry cleaning machines to evaporate, causing no environmental harm, and then disposed of the dried filters at a local landfill. Although at:one time, an employee did dispose of the waste PCE improperly, the top soil tested by Panzardi & Associates indicated only minute quantities of the chemical in the areas where the chemical had been disposed of improperly. Moreover, it appears that the Turpentine Run Basin Aquifer is also contaminated with Trichloroethylene and Methyline Chloride, solvents which are not used by L'Henri, Inc. in its dry *64493* 64493 Mr. Stephen D. Luftig November 1, 1989 cleaning operation. Based upon the foregoing, it appears at this time that L'Henri, Inc. did not contribute significantly, if at all, to the contamination of the Aquifer. Consequently, L'Henri, Inc. cannot agree to share in the cost of the investigatorial program as requested. L'Henri, Inc. will assume, of course, the responsibility for the cleanup of the contaminated top soil near the site of its dry cleaning operation. We will amend our initial response when all soil boring tests are completed by Panzardi & Associates. Please feel free to contact us if you wish to discuss this matter further.
